Creative ideas for the competition were submitted via the OpenAd website www.openad.net. By submitting work on OpenAd’s website, participants agreed to the Terms and Conditions and to the Author Agreement on OpenAd’s website. No entries or material was accepted by The Australian. The competition commenced on 27 September 2007. The deadline for submitting the entries was Friday 12 October 2007, 4pm (Australian Eastern Standard Time).
- These terms and conditions, Australia's Toughest Brief (the “Brief”), the OpenAd website terms and conditions (the “OpenAd Terms and Conditions”) and the OpenAd Author Agreement (the “Author Agreement”) include the instructions of how to take part in Australia’s Toughest Brief and shall govern the "Australia's Toughest Brief" competition (the "Competition"). The Competition is void where prohibited.
- All entrants must be aged 18 or over, and directors and employees of the Australian Newspaper (the “Australian”) and OpenAd and their associated companies, agencies and immediate family are excluded from entering.
- A winner will be the entrant who in the judges' opinion and sole discretion has submitted the best creative idea.
- A panel of judges will decide the winning entry. The judges' decision is final and no correspondence will be entered into. The winner will be notified by e-mail or phone by the Australian and/or by OpenAd.
- The winners were announced on Thursday 25 October 2007 within the Marketing and Media section of The Australian and the name(s) of the winner(s) will also be available at this time upon receipt of an SAE. The Australian will endeavour to arrange for further publication and promotion of the entry but is under no libation to do so. The winner will be required to confirm acceptance of the Prize. If the Prize is declined or unclaimed by the acceptance date or if the Prize winner cannot reasonably be contacted from the details supplied, the second place entry will be declared the winner and will be notified by phone and the original winning entry will then be forfeited. The winner may be required to complete and return a form by fax to confirm eligibility.

There are three prizes;
(1) BEST CREATIVE IDEA; $1000 AUS (any medium or nationality). (2) BEST PRINT AD; Award for the best print ad from someone residing in Australia; free entry and flights to the Newspaper industry's Caxton Awards at Byron Bay in northern NSW, October 26-28 (sponsored by The Australian). (3) BEST IDEA FROM AN AUSTRALIAN; $1000 (AUS) award for the best idea from an Australian, either a resident Australian or an Australian creative currently working in another country (with accompanying notification of residency or citizenship of Australia). - The Australian reserves the right to cancel or amend the terms of this Competition as required by circumstances.
- The winner will be liable to pay any applicable tax or duty imposed by any relevant authority.
- By entering the Competition you (and any contributors) agree to take part in any publicity relating to the Competition if you are invited to do so and without further compensation. Entrants warrant that they are the sole author of the entry and grant the Australian and OpenAd the right to publish and reproduce the entries in all form and media now or developed in the future throughout the world in perpetuity. During this period entries may be displayed on the OpenAd website.
- The Australian, OpenAd and their agents and subcontractors cannot accept responsibility for entries lost or delayed in submission. Proof of submission is not proof of receipt.
- To the fullest extent that may be excluded by the law. The Australian and/or OpenAd accepts no responsibility for or liability arising from entrants taking part in the Competition. The Australian and OpenAd reserve the right to cancel or amend the terms of this Competition by notice as required.
- Nationwide News Pty Limited (publisher of this newspaper) collects your information to include you in this competition and will disclose the information to others who help us run the competition. We may also use the information to assist us in improving our goods and services and to contact you in the future in regard to our other goods and services. We may share your information with other persons or entities that assist us in performing the above or with another company which provides prizes for the competition or reader offer.
