Do I need to sign any contracts?
When you register as a seller, you will be asked to read and accept the Author Agreement, which is the main document governing legal relations between sellers and OpenAd.net. It sets out the terms for posting creative material on the site, and clarifies procedures relating to the licensing of ideas by buyers.
You are then required to print two copies of the Assignment, which further indicates your acceptance of the Author Agreement, sign both of them and send them to: OpenAd UK Ltd, 8 Hanover St, London W1S 1YE, UK.
You may enter ideas before we have received your two signed copies of the Assignment; however, we will be unable to offer them for sale to Members until we have confirmed receipt.
^ topWhat are the legal implications for me when posting creative material on the site?
When an idea is first submitted, it is assessed by OpenAd.net. If the idea is accepted, the author is notified by email. Creative material accepted for posting on the site is partly assigned by the author to OpenAd.net for a period of 18 months. OpenAd.net also retains the right to take an extended assignment of all rights for the full life of the copyright by paying the author the perpetual licence fee at any time during these 18 months.

When you submit an idea to OpenAd.net, you have, in effect, registered that idea. However, we do advise creatives to obtain additional proof of authorship. This can be done in a number of ways:
- by posting the idea to your own place of residence
- by emailing the idea to yourself
- by registering your idea with a notary or intellectual property agency
- by going to www.idea-protector.com/openad. This site is run by the Idea Care Company, OpenAd.net's online partner in intellectual property rights registration, and allows creatives to register their ideas by means of a digital timestamp, thus proving when the idea was created.
I suspect that my intellectual property rights have been infringed. What do I do?
If an author suspects that a Member has infringed his intellectual property rights, and if he is able to provide reasonable and sufficient evidence of infringement, we will allow him to access the computer log of Members that viewed the idea before the infringement took place.
Any author who suspects that his intellectual property rights have been infringed may take advantage of OpenAd.net's association with Clintons, a London-based legal firm specialising in media and entertainment law. If the author can supply Clintons with the material in question, as well as the OpenAd.net computer log, they will send a letter proposing settlement to the person responsible for the suspected infringement.
Alternatively, an author can fill out a free-of-charge settlement letter template and send it to the person responsible for the suspected infringement, along with the OpenAd.net computer log.

The public use of ideas you have sold on OpenAd.net is not permitted; this also applies to any personal promotion you might carry out (for example, publishing the idea in your portfolio or in other promotional materials). If your idea has been bought but not yet published, it will be subject to a confidentiality agreement. You may use ideas for personal promotion purposes only when the Member has published the idea and only after you have addressed a written request to OpenAd.net.

The internet is not a 100% secure medium for communication. However, we do take every precaution to protect any information you send to us and we send to you. All personal information is stored on a server in a secure environment. Only employees who need the information to perform a specific task are granted access to data that identifies you personally. We hold regular security reviews to ensure that the site remains safe and secure.
Your account profile is password-protected to prevent others from viewing your personal information. You are solely responsible for maintaining the secrecy of your password(s) and/or any account information.
