/ PROTECTING IDEAS

Copyright protection has always been of the greatest importance to brands, advertisers and creatives. The rapid rise of the internet, with its ability to distribute information globally at the press of a button, has given rise to further concerns about how ideas might best be safeguarded from infringement.

 
OpenAd.net are sensitive to these concerns. We realise that, since all our transactions are conducted online, we have an extra duty to ensure that creatives are comfortable with the environment in which their ideas are displayed. Brands too must feel confident that when they license an idea through us, they are getting a 'clean' idea and one that is free of outstanding copyright issues.

The first layer of protection is provided by the fact that OpenAd.net is a closed, membership-only system. It is not a free-for-all, with brands and creatives wandering in and walking out with the best ideas to use elsewhere. Creatives only have access to their own work; Members only have access to the categories they specified in their membership package (and to their own pitch portfolio if they are holding a pitch for ideas).

We have also devised further layers of protection for creatives; these are outlined below. When taken together, they provide a secure and robust environment for the buying and selling of ideas

Protecting ideas

  • The first thing a creative does with an idea is protect it by registering it. The good news is that submitting an idea to OpenAd.net is a form of idea registration in itself.
     
  • Creatives wishing to further protect their ideas can take advantage of OpenAd.net's arrangement with the Idea Care Company, an online property rights organisation that allows creatives to register their ideas by means of a digital timestamp.
     
  • OpenAd.net regularly monitors Members' advertising and marketing communications to ensure that no infringements of creatives' material rights have taken place.
  • Creatives can also make use of OpenAd.net's association with Clintons, a London-based legal firm specialising in media and entertainment law. They offer legal advice to OpenAd.net creatives and a free-of-charge settlement letter template.
     
  • OpenAd Guard is a collection of OpenAd.net's policies regarding the protection of authors' copyright, and contains further details on all the above issues.
     
  • The Legal section of this site provides the creative with all he needs to know about the legal issues surrounding the buying and selling of ideas on OpenAd.net.
